All Children have a special set of rights to ensure they live their best lives. Those rights come from Constitutions, Protection of the rights of children act and the United Nations Children’s Convention. They ensure Children have access to the best standard of health, education, and to a say in everything that affects them.
Non-discrimination, Article 6
No Child shall be discriminated against based on their or their guardian’s race, or color, or sex, or language, political or other opinion, or national origin, or related family, or native island, or related social status, or any disability, or financial well-being, or any other factor.
Life and growth, Article 7
In the widest possible sense, every Child has the right to life and growth.
It is the duty of the guardians, family, individuals within the community, and the State to facilitate opportunities for Children to remain in a good health, provide facilities for the same, and take necessary steps to protect them from harm and abuse, in order to ensure that Children are afforded the right to life and growth in the widest possible sense.
Best the interests of the Child, Article 8
Protecting the interests of the Child should be the utmost priority when making decisions with regards to the Child, whether the decision is made by State institutions, or courts of law, or the People’s Majlis, or State or private parties providing social protection services, or guardians.
Right to express opinions, Article 9
Every Child who has the capability to form their own opinions shall have the right to express their opinions in all matters that relate to them.
Care and protection, Article 10
Every Child shall have the right to protection and care needed for their growth, from their guardians, family, community and the State.
Protection from sexual exploitation and sexual abuse, Article 11
Every Child has the right to be protected from sexual exploitation and from being sexually abused. This includes the right to be protected from the following:
- being victimized to sexual abuse;
- being forced to participate in acts of exploitation such as prostitution;
- being forced to participate in the making or producing of pornography and having the same shown to them.
Protection from violence, abuse and negligence, Article 12
Every Child has the right to be protected from all abuses that hinder their growth, such as all forms of physical and psychological violence, abuse, negligence, cruelty, exploitation and sexual abuse.
Protection from immoral matters of social and cultural nature, Article 13
Every Child has the right to be protected from social and cultural matters that may have a negative impact on the Child’s interests, reputation and growth.
Registration of live birth, and the right to name and nationality, Article 14
Every Child has the right to have their live birth registered, and to be given a name acceptable under the law, when they are born. The right to have the Child’s live birth registered includes a name acceptable under the law, sex, date of birth, place of birth, parents and nationality.
Right to maintain identity, Article 15
In order to maintain their personal identity, every Child has the right to have a record of the official information of their identity, the right to have such information protected, and the right to be protected from acts that may threaten their personal identity.
Right to know the parents, and to receive their care, Article 16
Every Child has the right to know who their parents are, and in case the child lives away with their parents, has the right to maintain regular contact with their parents were maintaining contact with them would not have a negative impact on the Child’s interests.
Right to seek and obtain information, Article 17
Every Child has the right to seek and obtain information appropriate to their age from national and international sources, regarding their social, spiritual and disciplinary well-being, and that which are needed for their physical and mental growth.
Children with disabilities, Article 18
Every Child with a disability has the right to lead a full-dignified life with equal opportunity to participate in the community, and to make decisions for themselves to the best of their capabilities without prejudice.
Right to remain in good health and the right to adequate healthcare, Article 19
Every Child has the right to the facilities required for a cure to the illness where they fall ill, and to the best available healthcare and services required for physical and mental well being.
Quality of life and social protection, Article 20
Every Child has the right to maintain their quality of life at an adequate level in order to achieve physical, mental, spiritual, disciplinary and social advancement.
Right to education, Article 21
Every Child has the right to education without discrimination.
The State shall make arrangements to enable every Child to obtain an education through a system that teaches and promotes Islamic beliefs, principles, Islamic upbringing, respecting human rights, importance of coexisting in peace and friendship with everyone in general.
Right to obtain and transact from property, Article 22
Every Child has the right to obtain, own, inherit, and transact from property in accordance with the law.
Guidelines shall be made to provide for the use, sale, and transfer of property in Children’s names, or those properties they will receive in inheritance, for their need before they are 18 years of age.
Right to rest, entertainment, and participation in cultural activities, Article 23
Every Child has the right to rest, and to participate in entertainment activities appropriate for their age, and cultural and creative activities.
Right to meet parents, relatives and family, Article 24
Where a Child lives away from their mother or father, they have the right to maintain regular contact with the person living separately from them, except where maintaining contact with them would have a negative impact on the Child’s interests.
Marriage not to be contracted for Children, Article 25
Given that Children have not achieved the same level of health and mental growth as adults, and since Article 35 (a) of the Constitution stipulates that they be given special assistance and special protection from their family, community and the State, marriage shall not be contracted for Children under 18 years of age.
No child labour, Article 26
Children have the right to be protected from labour that hinders their education or may have a negative impact on or pose a threat to their health, their physical, or mental, or spiritual, or social development.
Right to be protected from liquor, smoking and drug use, Article 27
Every Child has the right to be protected from acts such as use of liquor, smoking and drug use.
The State shall continue to take adequate steps through legal, administrative, social and educational means to protect Children against acts such as liquor consumption, smoking and drug use, and against the use of Children in the unlawful production, sale, and trafficking of such articles.
Obtaining testimony, Article 28
A Child shall be afforded safety and protection where their testimony has been obtained in a case.
Criminal responsibility, Article 29
Children under 15 years of age shall not be considered to have to take criminal responsibility for offences, in consideration of the fact that Children have not achieved the same level of health and mental growth as adults, and since Article 35 (a) of the Constitution stipulates that they be given special assistance and special protection from their family, community and the State.
No violence, or cruel, inhumane punishment, Article 30
No child shall be given cruel, inhumane or degrading punishment whether in the home they live in, or educational institutions, or care centres, or any other environment in which they live.
Treatment for Children who are victims of violence, abuse and negligence, Article 31
Every Child who is a victim of violence, abuse and negligence shall have the right to physical and mental treatment needed to reconnect with the community.
No arrests or detention except as provided for by the law, Article 32
A Child shall not be arrested or detained except as provided for by the law, and except as a matter of last resort. Even after detention, treatment and services aimed at re-introducing the Child back into the society shall be continued to be provided for the Child.
Not making public, information that would harm the reputation of Children, Article 33
No party shall make public, personal information of Children in a manner that would harm their reputation. Any information which could directly or indirectly lead to the identification of a Child, or their picture; or personal information such as name, address, information about the educational institution of Children who are suspected of an offence, victims of crime, or in need of care and protection for any other reason, shall not be published in any media or any other medium.
ކުޑަކުދިންނަށް ރައްކާތެރި އަދި ދުޅަހެޔޮ ދިރިއުޅުމެއް ކަށަވަރު ކުރުމުގެގޮތުން ޚާއްޞަ ޙައްޤުތަކެއް ލިބެއެވެ. މި ޙައްޤުތައް ލިބިދެނީ ދިވެހިރާއްޖޭގެ ޖުމްހޫރިއްޔާގެ ޤާނޫނުއަސާސީއިންނާއި ޤާނޫނު ނަންބަރު: 19/2019 (ކުޑަކުދިންގެ ޙައްޤުތައް ރައްކާތެރިކަމުގެ ޤާނޫނު) އިންނާއި ކުޑަކުދިންގެ ޙައްޤުތައް ރައްކާތެރިކުރުމާއި ބެހޭ ބައިނަލްއަޤްވާމީ މުއާހަދާއިންނެވެ. އެގޮތުން ކުޑަކުދިންނަށް އެންމެ ރަނގަޅު ޞިއްޙީ ފަރުވާއާއި، ކުޑަކުދިންނަށް އަސަރުކުރާ ކޮންމެ ކަމެއްގައި ވެސް ބަސް ބުނުމުގެ ފުރުޞަތު ފަހިކޮށްދެއެވެ.
ތަފާތުނުކުރުން، މާއްދާ 6
ކުއްޖާގެ ނުވަތަ ކުއްޖާގެ ބެލެނިވެރިއެއްގެ ނަޞްލަށް، ނުވަތަ ކުލައަށް، ނުވަތަ ޖިންސަށް، ނުވަތަ ބަހަށް، ނުވަތަ ސިޔާސީ ނުވަތަ އެނޫންވެސް ވިސްނުމަކަށް، ނުވަތަ އުފަންވީ ޤައުމަށް، ނުވަތަ ނިސްބަތްވާ ޢާއިލާއަށް، ނުވަތަ އުފަންވީ ރަށަށް، ނުވަތަ ނިސްބަތްވާ އިޖްތިމާޢީ މަރުކަޒަށް، ނުވަތަ އެއިން ފަރާތެއްގެ ކިބައިގައި ހުރި ނުކުޅެދުންތެރިކަމަކަށް، ނުވަތަ މާލީ ފުދުންތެރިކަމަށް، ނުވަތަ އެނޫންވެސް ކަމަކަށް ބިނާކޮށް، އެއްވެސް ކުއްޖަކާމެދު ތަފާތުކޮށްގެންނުވާނެ.
ދިރިހުރުމާއި ހެދިބޮޑުވުން، މާއްދާ 7
ކޮންމެ ކުއްޖަކަށްމެ ދިރިހުރުމާއި ހެދިބޮޑުވުމުގެ ޙައްޤު، އޭގެ އެންމެ ފުޅާ ދާއިރާގައި ލިބިގެންވޭ.
މި ޙައްޤު އޭގެ އެންމެ ފުޅާ ދާއިރާގައި ކުޑަކުދިންނަށް ކަށަވަރުކޮށްދިނުމަށްޓަކައި، ދުޅަހެޔޮ ޞިއްޙަތެއްގައި އެކުދިންނަށް ދެމިތިބެވޭނެ ފުރުޞަތު ފަހިކޮށްދީ، އެކަމަށް ބޭނުންވާ ވަސީލަތްތައް ހޯދައިދިނުމަކީ، އަދި އަނިޔާއާއި ގޯނާއިން އެކުދިން ސަލާމަތްކޮށްދިނުމަށްޓަކައި އަޅަންޖެހޭ ފިޔަވަޅުތައް އެޅުމަކީ، އެކުދިންގެ ބެލެނިވެރިންނާއި ޢާއިލާއާއި އެކުދިން ދިރިއުޅޭ މުޖުތަމަޢުގެ ފަރާތްތަކާއި، ދައުލަތުގެ ޒިންމާއެއް.
ކުއްޖާގެ މަޞްލަޙަތަށް އިސްކަންދިނުން، މާއްދާ 8
ދައުލަތުގެ އިދާރާތަކުންވިޔަސް ނުވަތަ ޝަރުޢީ ކޯޓުތަކުންވިޔަސް ނުވަތަ ރައްޔިތުންގެ މަޖިލީހުންވިޔަސް ނުވަތަ އިޖްތިމާޢީ ރައްކާތެރިކަން ފޯރުކޮށްދޭ ދައުލަތުގެ ނުވަތަ އަމިއްލަ ފަރާތަކުންވިޔަސް ނުވަތަ ބެލެނިވެރިން ކަމުގައިވިޔަސް، ކުޑަކުއްޖަކާގުޅޭ ކަންކަން ނިންމުމުގައި އެންމެ އިސްކަމެއް ދޭންވާނީ، އެކުއްޖާގެ މަޞްލަޙަތު ޙިމާޔަތްކުރުމަށް.
ރަޢުޔު ހާމަކުރުމުގެ ޙައްޤު، މާއްދާ 9
އަމިއްލަ ރަޢުޔެއް އުފަންކުރުމުގެ ޤާބިލުކަން ލިބިފައިވާ ކޮންމެ ކުއްޖަކަށްމެ، އެކުއްޖަކާގުޅޭ އެންމެހައި ކަންކަމުގައި އެކުއްޖާގެ ރަޢުޔު ހާމަކުރުމުގެ ޙައްޤު ލިބިގެންވޭ.
އަޅާލުމާއި ޙިމާޔަތް ލިބުން، މާއްދާ 10
ކުއްޖާ ހެދިބޮޑުވުމަށް ބޭނުންވާ ރައްކާތެރިކަމާއި އަޅާލުން، ކުއްޖާގެ ބެލެނިވެރިންގެ ފަރާތުންނާއި ކުއްޖާގެ ޢާއިލާގެ ފަރާތުންނާއި މުޖުތަމަޢުގެ ފަރާތުންނާއި ދައުލަތުގެ ފަރާތުން ލިބުމަކީ ކޮންމެ ކުއްޖަކަށްމެ ލިބިގެންވާ ޙައްޤެއް.
ޖިންސީގޮތުން ނާޖާއިޒު ބޭނުންހިފުމާއި، ޖިންސީ ގޯނާކުރުމުން ރައްކާތެރިކަން ލިބުން، މާއްދާ 11
ކޮންމެ ކުއްޖަކީވެސް، ޖިންސީގޮތުން އެކުއްޖެއްގެ ނާޖާއިޒު ބޭނުންހިފުމާއި، އެކުއްޖަކަށް ޖިންސީ ގޯނާކުރުމުން ރައްކާތެރިކަން ލިބުމުގެ ޙައްޤު ލިބިގެންވާ ކުއްޖެއް. އޭގެތެރޭގައި އަންނަނިވި ކަންކަމުން ރައްކާތެރިވުމުގެ ޙައްޤު ހިމެނިގެންވޭ.
(ހ) ޖިންސީ ގޯނާގެ ޝިކާރައަކަށްވުން؛
(ށ) ހަށިވިއްކުމުގެ ވިޔަފާރިއާއި އެނޫންވެސް އެކްސްޕްލޮއިޓޭޝަންގެ ޢަމަލުތަކުގައި ބައިވެރިކުރުވުން؛
(ނ) އޮރިޔާންކާޑު ހެދުމުގައި ނުވަތަ އުފެއްދުމުގައި ބައިވެރިކުރުމާއި ދެއްކުން.
އަނިޔާއާއި ގޯނާކުރުމާއި އަޅާނުލުމުން ރައްކާތެރިކަން ލިބުން، މާއްދާ 12
އެންމެހައި ބާވަތެއްގެ ޖިސްމާނީ އަދި ނަފްސާނީ އަނިޔާއާއި، ގޯނާކުރުމަކުންނާއި، އަޅާނުލުމާއި، އިހުމާލުވުމާއި، ނުބައިކޮށް ހިތުމާއި، ނާޖާއިޒް ފައިދާނެގުމާއި، ޖިންސީ ގޯނާކުރުމާއި، އެނޫންވެސް ކުއްޖާގެ ހެދިބޮޑުވުމަށް ހުރަސްއެޅޭނެ އެންމެހައި ޝިކާރަތަކު ކޮންމެ ކުއްޖަކަށްވެސް ރައްކާތެރިކަން ލިބުމުގެ ޙައްޤު ލިބިގެންވޭ.
ނޭދެވޭ އިޖްތިމާޢީ އަދި ޘަޤާފީ ކަންކަމުން ރައްކާތެރިކޮށްދިނުން، މާއްދާ 13
ކުއްޖާގެ މަޞްލަޙަތަށާއި، ކަރާމާތަށާއި ހެދިބޮޑުވުމަށް ނޭދެވޭ އަސަރެއް ފޯރާ ފަދަ އެންމެހައި އިޖްތިމާޢީ އަދި ޘަޤާފީ ކަންކަމުން ރައްކާތެރިކަން ލިބުމުގެ ޙައްޤު ކޮންމެ ކުއްޖަކަށް ލިބިގެންވޭ.
އުފަންވުން ރަޖިސްޓަރީވުމާއި ނަމާއި ޤައުމިއްޔަތުގެ ޙައްޤު، މާއްދާ 14
ކޮންމެ ކުއްޖަކުވެސް އުފަންވުމާއެކު، ޤާނޫނު ޤަބޫލުކުރާ ނަމެއް ލިބުމާއި، އެކުއްޖެއްގެ އުފަންވުން ރަޖިސްޓަރީކުރެވިފައި އޮތުމުގެ ޙައްޤު ލިބިގެންވޭ. އުފަންވުން ރަޖިސްޓަރީކުރެވިފައި އޮތުމުގެ ޙައްޤުގެ ތެރޭގައި، ޤާނޫނު ޤަބޫލުކުރާ ނަމަކާއި، ކުއްޖާގެ ޖިންސާއި، އުފަން ތާރީޚާއި، އުފަންވި ތަނާއި، މައިންބަފައިންނަކީ ކޮބައިކަމާއި، ޤައުމީ ނިސްބަތް ހިމެނޭގޮތުން، އެކުއްޖާގެ އުފަންވުމާގުޅޭ އެންމެހައި މަޢުލޫމާތު ރަޖިސްޓަރީކުރެވިފައި އޮތުމުގެ ޙައްޤު ހިމެނޭ.
އަމިއްލަވަންތަކަން ދެމެހެއްޓުމުގެ ޙައްޤު، މާއްދާ 15
އަމިއްލަވަންތަކަން ދެމެހެއްޓުމަށްޓަކައި، އެކުއްޖެއްގެ ކާކުކަން އަންގައިދޭ ރަސްމީ މަޢުލޫމާތުގެ ރެކޯޑެއް އޮތުމުގެ ޙައްޤާއި، އެ މަޢުލޫމާތު ޙިމާޔަތްކުރެވިފައި އޮތުމުގެ ޙައްޤާއި، ކުއްޖާގެ އަމިއްލަވަންތަކަން ނިގުޅައިގަނެވޭނެ ޢަމަލުތަކުން ރައްކާތެރިވުމުގެ ޙައްޤު، ކޮންމެ ކުއްޖަކަށްމެ ލިބިގެންވޭ.
މައިންބަފައިން އެނގުމާއި އެމީހުންގެ އަޅާލުން ލިބުމުގެ ޙައްޤު، މާއްދާ 16
މައިންބަފައިންނަކީ ކޮބައިކަން އެނގުމާއި، މައިން ބަފައިން ވަކިން ދިރިއުޅޭ ހާލަތުގައި، ކުއްޖާގެ މަސްލަހަތަށް ނޭދެވޭ އަސަރުނުކުރާނަމަ، މައިންބަފައިންނާއެކު ޤަވައިދުން ގުޅުންބާއްވައި، ކުއްޖާގެ ޢާއިލާ ދެނެގަނެ، އެފަރާތްތަކުގެ އަޅާލުން ލިބުމުގެ ޙައްޤު ކޮންމެ ކުއްޖަކަށްވެސް ލިބިގެންވޭ.
މަޢުލޫމާތު ހޯދައި ލިބިގަތުމުގެ ޙައްޤު، މާއްދާ 17
ކުއްޖާގެ އިޖްތިމާޢީ، ރޫޙާނީ އަދި އަޚްލާޤީ ދުޅަހެޔޮކަމާއި، ޖިސްމާނީގޮތުންނާއި ނަފްސާނީގޮތުން ކުއްޖާގެ ހެދިބޮޑުވުމަށް ބޭނުންވާ، ކުއްޖާގެ ޢުމުރާގުޅޭ މަޢުލޫމާތު، ޤައުމީ އަދި ބައިނަލްއަޤްވާމީ މަޞްދަރުތަކުން، ހޯދައި ލިބިގަތުމުގެ ޙައްޤު، ކޮންމެ ކުއްޖަކަށްމެ ލިބިގެންވޭ.
ނުކުޅެދުންތެރިކަން ހުންނަ ކުދިން، މާއްދާ 18
ނުކުޅެދުންތެރިކަމެއް ހުރި ކޮންމެ ކުއްޖަކަށްމެ، އެކުދިންގެ ޤާބިލިއްޔަތު ތަންދޭ މިންވަރަކުން އަދި އެކުދިންގެ ކަރާމާތަށް އުނިކަމެއް ނާންނާނެ ގޮތުގެމަތިން، އަމިއްލައަށް ކަންކަން ނިންމުމުގެ އިޚްތިޔާރާއި، މުޖުތަމަޢުގައި ބައިވެރިވުމުގެ ހަމަހަމަ ފުރުޞަތު ލިބި، އަބުރުވެރި ދިރިއުޅުމެއް އުޅުމުގެ ޙައްޤު ލިބިގެންވޭ.
ދުޅަހެޔޮ ޞިއްޙަތެއްގައި ދެމިތިބުމުގެ ޙައްޤާއި އެކަށީގެންވާ ޞިއްޙީ ފަރުވާ ލިބުމުގެ ޙައްޤު، މާއްދާ 19
ޖިސްމާނީގޮތުންނާއި ނަފްސާނީގޮތުން ދުޅަހެޔޮ ޞިއްޙަތަކަށް ވާޞިލުވުމަށް ބޭނުންވާ ޞިއްޙީ ފަރުވާއާއި ޚިދުމަތް، ލިބެންހުރި އެންމެ މަތީ ފެންވަރަކުން ލިބުމުގެ ޙައްޤާއި، ބަލިވުމުން، އެ ބައްޔަކަށް ފަރުވާ ހޯދޭނެ ވަސީލަތްތައް ލިބުމުގެ ޙައްޤު ކޮންމެ ކުއްޖަކަށްމެ ލިބިގެންވޭ.
ދިރިއުޅުމުގެ ފެންވަރާއި އިޖްތިމާޢީ ރައްކާތެރިކަން، މާއްދާ 20
ކޮންމެ ކުއްޖެއްވެސް ޖިސްމާނީގޮތުންނާއި، ނަފްސާނީގޮތުންނާއި، ރޫޙާނީގޮތުންނާއި، އަޚްލާޤީގޮތުންނާއި، އިޖްތިމާޢީގޮތުން ކުރިއެރުމަށްޓަކައި، އެކުއްޖެއްގެ ދިރިއުޅުމުގެ ފެންވަރު އެކަށީގެންވާ މިންވަރެއްގައި ދެމެހެއްޓުމުގެ ޙައްޤު ލިބިގެންވޭ.
އުނގެނުމުގެ ޙައްޤު، މާއްދާ 21
ކޮންމެ ކުއްޖަކަށްވެސް އެއްވެސް ތަފާތުކުރުމެއް ނެތި އުނގެނުމުގެ ޙައްޤު ލިބިގެންވޭ. މިގޮތުން އިސްލާމީ އަޤީދާއާއި އުސޫލުތަކާއި އިސްލާމީ ތަރުބިއްޔަތާއި، އިންސާނީ ޙައްޤުތަކަށް އިޙްތިރާމްކުރުމާއި، ޢާންމުކޮށް އެންމެންގެ މެދުގައި ސުލްޙަމަސަލަސްކަމާއި ރަޙުމަތްތެރިކަން ބާއްވައިގެން އުޅުމުގެ މުހިންމުކަމާއި، ދީމިޤްރާޠީ ހަމަތައް އުނގަންނައިދޭ، އަދި އެކަންކަމަށް ބާރުއަޅާ ތަޢުލީމީ ނިޒާމެއް މެދުވެރިކޮށް ކޮންމެ ކުއްޖަކަށްވެސް އުނގެނެވޭނެގޮތް ދައުލަތުން ހަމަޖައްސައިދޭންވާނެ.
މުދާ ހޯދައި މުދަލުން މުޢާމަލާތުކުރުމުގެ ޙައްޤު، މާއްދާ 22
ޤާނޫނުގައިވާ ގޮތުގެމަތިން މުދާ ހޯދުމާއި، މިލްކުކުރުމާއި، ވާރުތަކުރުމާއި، މުދަލުން މުޢާމަލާތުކުރުމުގެ ޙައްޤު ކޮންމެ ކުއްޖަކަށް ލިބިގެންވޭ.
މީގެ ތެރޭގައި ކުޑަކުދިންގެ ނަމުގައި ހުރި މުދަލާއި އެކުދިންނަށް ވާރުތަ ނުވަތަ ތަރިކައިގެ ތެރެއިން ލިބޭނެ މުދާ އެކުދިންނަށް 18 (އަށާރަ) އަހަރު ވުމުގެ ކުރިން އެކުދިންގެ ބޭނުންތަކަށް ބޭނުންކުރުމާއި، ވިއްކާލުމާއި، ބަދަލުކުރުމާބެހޭ އުސޫލުތައް ހެދުން ހިމެނޭ.
އަރާމުކުރުމާއި، މުނިފޫހިފިލުވުމާއި، ޘަޤާފީ ޙަރަކާތްތަކުގައި ބައިވެރިވުމުގެ ޙައްޤު، މާއްދާ 23
ކޮންމެ ކުއްޖަކަށްމެ އަރާމުކުރުމާއި، އެކުއްޖާގެ ޢުމުރާގުޅޭ ކުޅިވަރާއި މުނިފޫހިފިލުވުމުގެ ޙަރަކާތްތަކުގައި ބައިވެރިވުމާއި، ޘަޤާފީ ކަންކަމާއި، ފަންނުވެރި ކަންކަމުގައި ބައިވެރިވުމުގެ ޙައްޤު ލިބިގެންވޭ.
މައިންބަފައިންނާއި، ގާތްތިމާގެ މީހުންނާއި ޢާއިލާއާ ބައްދަލުކުރުމުގެ ޙައްޤު، މާއްދާ 24
ކުއްޖާގެ މަޞްލަޙަތަށް ނޭދެވޭ އަސަރެއް ކޮށްފާނެ ޙާލަތެއްގައި މެނުވީ، ކުއްޖާގެ މަންމަ ނުވަތަ ބައްޕައާ ވަކިން ދިރިއުޅޭ ޙާލަތުގައި، ކުއްޖާއާ ވަކިން ދިރިއުޅޭ ފަރާތާ ގަވާއިދުން ބައްދަލުކޮށް، ގުޅުން ބަދަހިކުރުމުގެ ޙައްޤު، ކޮންމެ ކުއްޖަކަށްމެ ލިބިގެންވޭ.
ކުޑަކުދިންގެ ކާވެނިކޮށް ނުދިނުން، މާއްދާ 25
ކުޑަކުދިންނަކީ، ޞިއްޙީގޮތުންނާއި ނަފްސާނީގޮތުން ބޮޑެތި މީހުންނާ އެއް މިންވަރަކަށް ހެދިބޮޑުވެފައިވާ ބައެއް ކަމުގައިނުވާތީއާއި، އެކުދިންނަކީ ޢާއިލާގެ ފަރާތުންނާއި ޖަމާޢަތުގެ ފަރާތުންނާއި ދައުލަތުގެ ފަރާތުން ޚާއްޞަ އެހީތެރިކަމާއި ޚާއްޞަ ރައްކާތެރިކަން ލިބިދޭންޖެހޭ ބައެއްކަމުގައި ޤާނޫނުއަސާސީގެ 35 ވަނަ މާއްދާގެ (ހ) ގައި ކަނޑައަޅާފައިވާތީ، ޢުމުރުން 18 (އަށާރަ) އަހަރުން ދަށުގެ ކުޑަކުދިންނަށް ކާވެނި ޢަޤުދުކޮށްދީގެންނުވާނެ.
ކުޑަކުދިން ލައްވާ މަސައްކަތް ނުކުރުވުން، މާއްދާ 26
ކުއްޖާއަށް ތަޢުލީމު އުނގެނުމަށް ހުރަސްއެޅޭ ފަދަ ނުވަތަ ކުއްޖާގެ ޞިއްޙަތަށް ނުވަތަ ކުއްޖާގެ ޖިސްމާނީ ނުވަތަ ނަފްސާނީ ނުވަތަ ރޫޙާނީ ނުވަތަ އިޖްތިމާޢީ ތަރައްޤީއަށް ނޭދެވޭ އަސަރެއް ނުވަތަ ގެއްލުމެއް ކުރިމަތިކުރުވަފާނެ ފަދަ މަސައްކަތްތަކުން ރައްކާތެރިކަން ލިބުމުގެ ޙައްޤު ކޮންމެ ކުއްޖަކަށްވެސް ލިބިގެންވޭ.
ބަނގުރަލާއި، ދުންފަތުގެ އިސްތިޢުމާލުކުރުމާއި، މަސްތުވާތަކެތި ބޭނުންކުރުމުން ރައްކާތެރިވުމުގެ ޙައްޤު، މާއްދާ 27
ބަނގުރާ ބުއިމާއި، ދުންފަތުގެ އިސްތިޢުމާލުކުރުމާއި، މަސްތުވާތަކެތި ބޭނުންކުރުން ފަދަ ޢަމަލުތަކުން ރައްކާތެރިވުމުގެ ޙައްޤު ކޮންމެ ކުއްޖަކަށްމެ ލިބިގެންވޭ.
މިފަދަތަކެތީގެ ޝިކާރަތަކުން ރައްކާތެރިކޮށްދިނުމަށް ޤާނޫނީގޮތުންނާއި، އިދާރީގޮތުންނާއި، އިޖްތިމާޢީގޮތުންނާ އަދި ތަޢުލީމު އުނގަންނައިދިނުމުގެ ތެރެއިން އެޅެންހުރި ފިޔަވަޅުތަކާއި، އެފަދަ ތަކެތި ނަހަމަގޮތުގައި އުފެއްދުމާއި، ވިއްކުމާއި، އެތަކެތި ޓްރެފިކްކުރުމުގައި ކުޑަކުދިން ބޭނުންކުރާ ކުރުމާ ދެކޮޅަށް އެކަށީގެންވާ ފިޔަވަޅުތައް ދައުލަތުން އަޅަމުން ގެންދަންވާނެ.
ހެކިބަސް ހޯދުން، މާއްދާ 28
އެއްވެސް މައްސަލައެއްގައި، ކުޑަކުއްޖެއްގެ ފަރާތުން ހެކިބަހެއް ހޯދައިފިނަމަ، އެކުއްޖާއަށް ރައްކާތެރިކަމާއި ޙިމާޔަތް ލިބެންވާނެ.
ޖިނާއީ މަސްއޫލިއްޔަތު އުފުލުން، މާއްދާ 29
ކުޑަކުދިންނަކީ، ނަފްސާނީގޮތުންނާއި ޖިސްމާނީގޮތުން ބޮޑެތި މީހުންނެކޭ އެއްފަދައިން ހެދިބޮޑުވެފައިވާ ބައެއް ކަމުގައިނުވާތީއާއި، އެކުދިންނަކީ ދައުލަތުގެ ފަރާތުންނާއި ޢާއިލާގެ ފަރާތުންނާއި ޖަމާޢަތުގެ ފަރާތުން ޚާއްޞަ އެހީތެރިކަމާއި ޚާއްޞަ ރައްކާތެރިކަން ލިބިދޭންޖެހޭ ބައެއް ކަމުގައި ޤާނޫނުއަސާސީގެ 35 ވަނަ މާއްދާގެ (ހ) ގައި ކަނޑައަޅާފައިވާތީ، އެކަމަށް ރިޢާޔަތްކުރުމާއެކު، ޢުމުރުން 15 (ފަނަރަ) އަހަރުން ދަށުގެ ކުޑަކުދިންނަކީ ކުށުގެ ޖިނާއީ މަސްއޫލިއްޔަތު އުފުލަންޖެހޭ ކުދިން ކަމުގައެއް ނުބެލެވޭނެ.
ރަޙުމްކުޑަ، ލާއިންސާނީ އަދަބު ނުދިނުމާއި އަނިޔާނުކުރުން، މާއްދާ 30
ކުއްޖާ ދިރިއުޅެމުންގެންދާ ގޭތެރޭގައިވެސް ނުވަތަ ތަޢުލީމްދޭ މަރުކަޒެއްގައިވެސް ނުވަތަ ކުއްޖާ ބަލަހައްޓާ މަރުކަޒެއްގައިވެސް ނުވަތަ އެކުއްޖާ ދިރިއުޅޭ އެނޫންވެސް މާޙައުލެއްގައި، ރަޙުމްކުޑަ، ލާއިންސާނީ، ނުވަތަ ކުއްޖާ ލަދުގަންނާނެ ފަދަ އަދަބެއް ދީގެންނުވާނެ.
އަނިޔާކުރުމާއި ގޯނާކުރުމާއި އިހުމާލުވުމުގެ ޝިކާރައަކަށްވާ ކުދިންނަށް ފަރުވާ ލިބިދިނުން، މާއްދާ 31
އަނިޔާކުރުމާއި ގޯނާކުރުމާއި އިހުމާލުވުމުގެ ޝިކާރައަކަށްވާ ކުދިން އަނބުރާ މުޖުތަމަޢާ ގުޅުމަށް ބޭނުންވާ ޖިސްމާނީ އަދި ނަފްސާނީ ފަރުވާ ލިބުމުގެ ޙައްޤު، ކޮންމެ ކުއްޖަކަށްމެ ލިބިގެންވޭ.
ޤާނޫނާ އެއްގޮތްވާ ގޮތުގެމަތިން މެނުވީ ހައްޔަރުނުކުރުމާއި ބަންދުނުކުރުން، މާއްދާ 32
ޤާނޫނާ އެއްގޮތްވާ ގޮތުގެމަތިން މެނުވީ، އަދި އެންމެ ފަހުގެ ފިޔަވަޅެއްގެ ގޮތުގައި މެނުވީ، ކުޑަކުއްޖަކު ހައްޔަރުކޮށް ނުވަތަ ބަންދުކޮށްގެންނުވާނެ. އަދި ބަންދުކުރުމަށް ފަހުގައިވެސް، އެކުއްޖާ އަނބުރާ މުޖުތަމަޢަށް ރުޖޫޢަކުރުމަށް އަމާޒުކޮށްގެން ދެވޭ ފަރުވާއާއި ޚިދުމަތްތައް ކުއްޖާއަށް ފޯރުކޮށްދެމުންގެންދަންވާނެ.
ކުޑަކުދިންގެ ކަރާމާތަށް އުނިކަން އަންނަ މަޢުލޫމާތު ޢާންމުނުކުރުން، މާއްދާ 33
ކުޑަކުދިންގެ ކަރާމާތަށް އުނިކަން އަންނަ ގޮތަކަށް، ކުޑަކުދިންގެ ޒާތީ މަޢުލޫމާތު އެއްވެސް ފަރާތަކުން ޢާންމުކޮށްގެންނުވާނެ. މިގޮތުން ކުށުގެ ތުހުމަތުގައިވާ ކުދިންނާއި، ކުށުގެ ޝިކާރައަކަށް ވެފައިވާ ކުދިންނާއި، އެނޫންވެސް ސަބަބަކަށްޓަކައި އަޅާލުމާއި ރައްކާތެރިކަން ބޭނުންވާ ކުދިންގެ ނަމާއި، އެޑްރެހާއި، ތަޢުލީމު ޙާޞިލުކުރާ ތަނުގެ މަޢުލޫމާތު ފަދަ ޒާތީ މަޢުލޫމާތެއް ނުވަތަ ސީދާގޮތުން ނުވަތަ ނުސީދާގޮތުން ނަމަވެސް ކުއްޖާއަކީ ކާކުކަން ދެނެގަނެވޭނެ ފަދަ އެއްވެސް މަޢުލޫމާތެއް ނުވަތަ އެކުދިންގެ ތަސްވީރެއް، އެއްވެސް މީޑިއާގެ ނުވަތަ އެނޫންވެސް ވަސީލަތެއްގައި ޝާއިޢުކޮށްގެން ނުވާނެ.
