Duties of the state
It is a duty of the State to take all necessary legal, administrative and other steps to ensure that the all rights are available to Children.
It is a duty of the State to carry out all its responsibilities under the International Convention on the Rights of the Child, its optional protocols, and other international treaties relating to the protection of the rights of Children and to take all steps necessary to implement matters in those treaties.
The State shall ensure that the laws and regulations in force in the Maldives protect the rights of Children and are laws that have been made in a manner that would not have any negative impact on the rights of Children.
It is a duty of the State to provide adequate facilities to enable parents to carry out their responsibilities in the care and upbringing of Children.
It is a duty of the State to hold the parents accountable and provide care and protection to Children where the parents are negligent in providing their Children with the right and protection they deserve.
Where any of the services given to Children are privatized, the State shall establish a mechanism to monitor and hold accountable, the institutions that provide services to Children to ensure that their services are provided in accordance with the standards stipulated in this Child Protection Act (19/2019) and the regulations made hereunder.
The State shall establish a mechanism to seek their opinion and ensure participation of Children as much as possible, where the State makes decision in matters related to Children.
The State shall make public, information related to the rights of Children, their responsibilities, and the duties of parents and others, in order to raise awareness amongst stakeholders, and conduct programs to raise awareness amongst Children and the community about it.
Duties of Councils
Enforcing the policies related to protection of the rights of Children and provision of care and protection to them at the council level, in accordance with the instructions of the Ministry;
Planning and organizing different projects within constituencies or areas of the council’s jurisdiction regarding protection of the rights of Children and provision of care and protection to them, and taking necessary relevant steps in accordance with instructions of the Ministry;
Monitoring the works being carried out to enforce the Child Rights Act (19/2019) within the jurisdictions of the councils, and report to the Ministry as instructed by the Ministry;
Reporting to the authorities designated under the Child Rights Act (19/2019), information about cases of negligence of parents towards their Children, and violence against Children;
Seeking the participation of civil society organisations and citizens who belong to those councils, in carrying out the works related to protection of the rights of Children within the jurisdiction of those councils;
Assisting the Ministry to enforce the regulations made under this Act within the council level;
Points highlighted in the Child Rights Act (19/2019) in regard with the Councils
- Where certain responsibilities are to be delegated to island council level or atoll council level or city council level, it shall be done so by explicitly providing necessary resources and in accordance with the policies of the Ministry.
- Island councils and city councils shall only be appointed as agents for that jurisdiction for enforcement of Child Protection Act (19/2019) after training the technical staff of the councils relevant to protection of the rights of Children.
- Employee shall be designated from each of the island and city councils to work on matters related to rights of Children, such work shall be included in their employment duties and they shall be given adequate training.
Duties of Healthcare System
Provide reproductive healthcare for the Child and the mother from conception; and other healthcare included within the right to remain in a good health.
It is the duty of the Child’s parents and the State to provide healthcare and services and facilitate such services from the Child’s conception and after they are born.
Provide adequate healthcare services to all the children.
Establish healthcare services and facilitate such matters and ensure that no Child is singled out from such services.
Establishing a mechanism to take prompt action in issues related to Children through health centres.
Provide facilities required for a cure to the illness and to the best available healthcare and services required for physical and mental well-being.
Ensure child is prevented from cultural traditions and acts which may be harmful to the Child’s health.
Provide every Child the right; to receive food and clean water required for their growth in good health; to receive services of an adequate sewage system; to receive adequate clothing and housing; and to be able to grow up in a clean environment which is beneficial for health.
Provide adequate and good quality healthcare; information, facilities and services appropriate to the Child’s age required for prevention of diseases.
Points highlighted in the Child Rights Act (19/2019) in regard with the Healthcare system
- Every child has the right to remain in good health and right to adequate healthcare.
- Court may grant power to Child and Family Protection Service or the Maldives Police Service to order to conduct medical examinations necessary for the Child, and to provide healthcare, where the Child has an illness or has been a victim of violence.
- A doctor or healthcare professional of a Child in need of care and protection can report a case related to a Child.
Duties of Maldives Police Service
Take proactive steps to ensure the protection of the rights of children.
Name, or any other information which can reveal the identity of the person who reported a case to Child and Family Protection Service and the Maldives Police Service under this Act shall not be shared with a third party.
Where a case regarding a Child has been lodged with the Maldives Police Service, information about the case shall be shared with Child and Family Protection Service as soon as practicable.
Except for the things mentioned on Juvenile Justice Act and as a last resort a child should not be taken into custody.
Except in cases specifically outlined in the Juvenile Justice Act, the use of custody as a means of addressing the actions or circumstances of a child shall only be employed as a last resort. All alternative measures and supports shall be exhausted before resorting to the use of custody for a child.
Points highlighted in the Child Rights Act (19/2019) in regard with the Maldives Police Service
- The Maldives Police Service may submit to the court asking for an order for interim assessment.
- Court may grant power to the Maldives Police Service to order to do any of the following under an order for interim assessment:: (1) to continue maintaining relationship with the Child; Protection of the Rights of Children Act 39; (2) to conduct medical examinations necessary for the Child, and to provide healthcare, where the Child has an illness or has been a victim of violence; and (3) the parents not to have any direct or indirect contact with the Child except in the presence a certain person, where the danger to the Child has been caused from their parents.
- The Maldives Police Service may ask the court for an extension of the order for interim assessment granted in relation to a certain Child.
- A member from Maldives Police service sits in the Council for protection of the rights of children.
Duties of Child and Family Protection Services
Providing assistance and cooperation to Children and their families, who are in need of assistance.
Protecting and promoting the interests of Children in need of assistance.
Investigating cases submitted relating to the rights of Children, and finding a solution to those cases with the assistance and cooperation from the relevant institutions.
Making arrangements for provision of the following minimum services to provide care and assistance to Children.
Coordinating with the National Drug Agency regarding provision of treatment to Children who are victims of drug addiction.
Carrying out the responsibilities of the Minister under the laws in practice, with regards to Children who are brought under State care.
Carrying out all the functions relating to fostering of Children brought under State care.
Establishing cooperation between different fields in relation to Children brought under State care, and being fostered, and coordinating the work between such institutions.
Providing the required assistance or services to Children in need of such assistance, with a focus on their needs
Maintaining a register of information mentioned in the Child Protection Act.
Conducting research on protecting the rights of Children.
Collecting and publishing data needed to plan, organize, monitor and evaluate the work carried out for protection of the rights of Children. Accordingly, collecting and publishing detailed data or disaggregated data on Children’s age, sex, type of disability, geographic area where Children live in or belong to, and their social and economic conditions.

Duties of Education System
Every Child living in the Maldives has the right to education without discrimination.
It is compulsory for Children’s parents and the State to educate Children living in the Maldives about elementary education, primary education and upbringing.
The State shall make arrangements to enable every Child to obtain an education through a system that teaches and promotes Islamic beliefs, principles, Islamic upbringing, respecting human rights, importance of coexisting in peace and friendship with everyone in general.
Every Child has the right to be protected from having to do work that hinders their education or may have a negative impact on or pose a threat to their health, their physical, or mental, or spiritual, or social development.
No child shall be given cruel, inhumane or degrading punishment whether in the home they live in, or educational institutions, or care centres, or any other environment in which they live. Neither should they be subjected to any form of violence.
To the best of their ability and financial capacity, the State shall create adequately safe and good quality spaces where Children can play and entertain themselves.
Establish an educational system stipulated in this Section, facilitate in reaching it, and ensure that there is no Child singled out from obtaining elementary and primary education.
Form a system that identifies Children who are not sent to schools and ensures that they are sent to school.
Points highlighted in the Child Rights Act (19/2019) in regard with the Education system
- It is prohibited to employ or engage for work, a Child who has not attained 16 years of age, except for the purpose of training them in relation to their education or upbringing.
- Where the law permits, it is an exemption to involve a Child who has not attained 16 years of age, with their consent, in the work carried out by their family.
- Involving a Child in the work carried out by their family is permitted where that particular work is not one that hinders their education or may have a negative impact on or pose a threat to their health, their physical, or mental, or spiritual, or social development.
Important general points highlighted in the Child Rights Act (19/2019)
- Any person who has reasons to believe that a particular Child is in need of care and protection shall report the matter to Child and Family Protection Service or the Maldives Police Service.
- Any information which could directly or indirectly lead to the identification of a Child, or their picture; or personal information such as name, address, information about the educational institution of Children who are suspected of an offence, victims of crime, or in need of care and protection for any other reason, shall not be published in any media or any other medium.
ދައުލަތުގެ ޒިންމާ
ޤާނޫނުގައި ބަޔާންކުރާ ޙައްޤުތައް ކުޑަކުދިންނަށް ކަށަވަރުކޮށްދިނުމަށްޓަކައި ޤާނޫނީގޮތުންނާއި އިދާރީގޮތުންނާއި އެނޫންވެސް ގޮތްގޮތުން އަޅަންޖެހޭ ފިޔަވަޅުތައް އެޅުން.
ކުޑަކުދިންގެ ޙައްޤުތައް ރައްކާތެރިކޮށްދިނުމުގެ ބައިނަލްއަޤްވާމީ މުޢާހަދާއާއި އެނޫންވެސް ދިވެހިރާއްޖެއިން ބައިވެރިވެފައިވާ ކަމާގުޅޭ ބައިނަލްއަޤްވާމީ މުޢާހަދާތަކުގެ ދަށުން ދައުލަތުން އަދާކުރަންޖެހޭ މަސްއޫލިއްޔަތުތައް އަދާކުރުން.
ދިވެހިރާއްޖޭގައި ޢަމަލުކުރެވޭ ޤާނޫނުތަކާއި ގަވާއިދުތަކަކީ، ކުޑަކުދިންގެ ޙައްޤުތައް ޙިމާޔަތްކޮށްދެވޭ، އަދި އެކުދިންގެ ޙައްޤުތަކަށް އެއްވެސް އުނިކަމެއް ނާންނާނެ ގޮތުގެމަތިން އެކުލަވާލެވޭ ޤާނޫނުތަކެއްކަން ދައުލަތުން ކަށަވަރުކުރުން.
ދަރިން ބަލައިބޮޑުކޮށް ތަރުބިއްޔަތުކުރުމުގައި މައިންބަފައިން އަދާކުރަންޖެހޭ މަސްއޫލިއްޔަތުތައް އަދާކުރުމަށް މަގުފަހިކޮށްދިނުމަށްޓަކައި، އެކަށީގެންވާ ވަޞީލަތްތައް ފޯރުކޮށްދިނުން.
ކުޑަކުދިންނަށް ލިބިދޭންޖެހޭ ޙައްޤުތަކާއި ރައްކާތެރިކަން ކަށަވަރުކޮށްދިނުމުގައި މައިންބަފައިން އިހުމާލުވެއްޖެނަމަ، އެކުދިންގެ މައިންބަފައިން ޒިންމާދާރުކުރުވައި، އެކުދިންނަށް އަޅާލުމާއި ރައްކާތެރިކަން ފޯރުކޮށްދިނުން.
ކުޑަކުދިންނަށް ޚިދުމަތް ފޯރުކޮށްދިނުމުގައި އެއްވެސް ޚިދުމަތެއް ޕްރައިވަޓައިޒްކުރާނަމަ، އެ ޚިދުމަތް ފޯރުކޮށްދެނީ، މި ޤާނޫނާއި ގަވާއިދުތަކުގައި ކަނޑައަޅާފައިވާ މިންގަނޑުތަކާ އެއްގޮތްވާ ގޮތުގެމަތިންކަން ކަށަވަރުކުރުމަށްޓަކައި، އެފަދަ ތަންތަން މޮނިޓަރކޮށް، ޖަވާބުދާރީކުރުވޭނެ ނިޒާމެއް ދައުލަތުން ހަމަޖެއްސުން.
ދައުލަތުގެ ފަރާތުން ކުޑަކުދިންނާގުޅޭ ކަންކަން ނިންމުމުގައި، ވީވަރަކުން ކުޑަކުދިން ބައިވެރިކޮށް، އެކުދިންގެ ޚިޔާލު ހޯދޭނެ ނިޒާމެއް ޤާއިމުކުރުން.
ޤާނޫނާގުޅޭގޮތުން ކަމާބެހޭ ފަރާތްތައް ހޭލުންތެރިކުމަށްޓަކައި މަޢުލޫމާތު ޢާންމުކުރުމާއި، އެކަންކަމާ ގުޅޭގޮތުން މުޖުތަމަޢުއާއި ކުޑަކުދިން ހޭލުންތެރިކުރުމަށްޓަކައި ދައުލަތުން ޕްރޮގްރާމްތައް ހިންގުން.
ކައުންސިލްގެ ޒިންމާ
ޤާނޫނުގެ ދަށުން، ރަށު، އަތޮޅު ނުވަތަ ސިޓީ ކައުންސިލުތަކުގެ މަސްއޫލިއްޔަތު އުފުލުމަށް މަގުފަހިކޮށްދީ، ޤާނޫނީ ބާރު ލިބިދިނުމުގެގޮތުން، އެ ކައުންސިލެއް ނިސްބަތްވާ ސަރަޙައްދުގައި، ޤާނޫނު ތަންފީޛުކުރުމަށްޓަކައި އެ ސަރަޙައްދަށް ޢައްޔަނުކުރެވޭ އޭޖެންޓުގެ ގޮތުގައި ކައުންސިލެއް ކަނޑައެޅުމުން އޭޖެންޓުގެ ދައުރު އަދާކުރުން.
ކުޑަކުދިންގެ ޙައްޤުތައް ރައްކާތެރިކުރުމާއި، ކުޑަކުދިންނަށް އަޅާލުމާއި ރައްކާތެރިކަން ފޯރުކޮށްދިނުމުގެ ސިޔާސަތުތައް މިނިސްޓްރީން އަންގާ ގޮތެއްގެމަތިން ކައުންސިލުގެ ފެންވަރުގައި ތަންފީޛުކުރުން.
ކުޑަކުދިންގެ ޙައްޤުތައް ރައްކާތެރިކުރުމާއި، ކުޑަކުދިންނަށް އަޅާލުމާއި ރައްކާތެރިކަން ފޯރުކޮށްދިނުމާ ގުޅޭގޮތުން އެކިއެކި މަޝްރޫޢުތައް ރާވައި ހިންގުމާއި، ކަމާގުޅޭގޮތުން އަޅަންޖެހޭ ފިޔަވަޅުތައް މިނިސްޓްރީން އަންގާ ގޮތެއްގެމަތިން އެޅުން.
ޤާނޫނު ތަންފީޛުކުރުމުގެ ގޮތުން ރާވައި ހިންގާ އެކިއެކި މަސައްކަތްތައް ހިނގާ ނުހިނގާ ގޮތް މިނިސްޓްރީން އަންގާ ގޮތެއްގެމަތިން ބަލައި ރިޕޯޓްކުރުން.
ކުޑަކުދިންނާމެދު މައިންބަފައިން އިހުމާލުވާ މައްސަލަތަކާއި، ކުޑަކުދިންނަށް ކުރާ އަނިޔާއާގުޅޭ މަޢުލޫމާތު ޤާނޫނުގެ ދަށުން ރިޕޯޓްކުރަންޖެހޭ ފަރާތްތަކަށް ރިޕޯޓްކުރުން.
ކުޑަކުދިންގެ ޙައްޤުތައް ރައްކާތެރިކުރުމަށް ކުރެވޭ މަސައްކަތްތައް ކުރުމުގައި އެ ކައުންސިލަށް ނިސްބަތްވާ ރައްޔިތުންނާއި އަމިއްލަ ޖަމާޢަތްތަކުގެ ބައިވެރިވުން ހޯދުން.
ޤާނޫނުގެ ދަށުން ހަދާ ގަވާއިދުތައް ކައުންސިލުގެ ފެންވަރުގައި ތަންފީޛުކުރުމުގައި މިނިސްޓްރީއަށް އެހީތެރިކަން ފޯރުކޮށްދިނުން.
ކައުންސިލްތަކާ ގުޅިގެން ޤާނޫނުގައި ބަޔާންކުރާ ބައެއް ނުކުތާތައް
- ޤާނޫނު ތަންފީޛުކުރުމުގެ ޒިންމާއާއި، ބާރެއް ނުވަތަ މަސްއޫލިއްޔަތެއް، ރަށު، އަތޮޅު ނުވަތަ ސިޓީ ކައުންސިލަކާ ޙަވާލުކުރަންވާނީ، ބޭނުންވާ ވަޞީލަތްތައް އެ ކައުންސިލަކަށް ފޯރުކޮށްދިނުމާއެކު، މިނިސްޓަރީގެ ފަރާތުން ކަނޑައަޅާ ސިޔާސަތާ އެއްގޮތްވާ ގޮތުގެމަތިންކަން.
- ޤާނޫނު ތަންފީޛުކުރުމަށްޓަކައި އެ ސަރަޙައްދަށް ޢައްޔަނުކުރެވޭ އޭޖެންޓެއްގެ ގޮތުގައި ރަށު އަދި ސިޓީ ކައުންސިލުތައް ކަނޑައަޅަންވާނީ، އެއިން ކޮންމެ ކައުންސިލެއްގައި ކުޑަކުދިންގެ ޙައްޤުތަކާ ގުޅޭގޮތުން ކަމާގުޅޭ ފަންނީ މުވައްޒަފުން ތަމްރީނު ކުރުމަށްފަހުގައިކަން.
- ކޮންމެ ސިޓީ އަދި ރަށު ކައުންސިލެއްގައި ކުޑަކުދިންގެ ޙައްޤުތަކާ ގުޅޭގޮތުން މަސައްކަތްކުރާނެ މުވައްޒަފަކު ކަނޑައަޅައި، އެކަން އެ މުވައްޒަފެއްގެ ވަޒީފާގެ މަސްއޫލިއްޔަތުތަކުގެ ތެރޭގައި ހިމަނައި، އެފަރާތަށް އެކަށީގެންވާ ތަމްރީން ދޭންވާނެކަން.
ޞިއްޙީ ދާއިރާގެ ޒިންމާ
މައިމީހާގެ ބަނޑުގައި ކުއްޖާ ގަރުބަގަތީއްސުރެ އެކުއްޖާއަށާއި އެކުއްޖާގެ މައިމީހާއަށް ލިބެންވާ ދަރިމައިވުމާގުޅޭ ޞިއްޙީ ފަރުވާއާއި އެނޫންވެސް ޞިއްޙީ ފަރުވާ ފޯރުކޮށްދިނުން.
ކޮންމެ ކުއްޖަކަށް މައިމީހާގެ ބަނޑުގައި ކުއްޖާ ގަރުބަގަތީއްސުރެ ވިހެއުމަށްފަހު ބޭނުންވާ ޞިއްޙީ ފަރުވާއާއި ޚިދުމަތްތައް ލިބިދިނުމާއި، އެފަދަ ޚިދުމަތްތަކަށް ވާޞިލުވެވޭނެ މަގުފަހިކޮށްދިނުން.
އެކަށީގެންވާ ރަނގަޅު ފެންވަރުގެ ޞިއްޙީ ޚިދުމަތްތައް ކޮންމެ ކުއްޖަކަށްމެ ފޯރުކޮށްދިނުން.
ޞިއްޙީ ފަރުވާއާއި ޚިދުމަތްތައް ޤާއިމުކޮށް، އެކަންކަމަށް ވާޞިލުވެވޭނެ މަގުފަހިކޮށްދިނުމާއި، އެފަދަ ޚިދުމަތްތަކަށް ވާޞިލުވުމުން މަޙްރޫމުވެފައިވާ ކުއްޖަކު ނެތްކަން ކަށަވަރުކުރުން.
ޞިއްޚީ މަރުކަޒުތައް މެދުވެރިކޮށް ކުޑަކުދިންގެ މައްސަލަތަކުގައި އަވަހަށް ފިޔަވަޅު އެޅޭނެ ނިޒާމެއް ޤާއިމުކުރުން.
ޖިސްމާނީގޮތުންނާއި ނަފްސާނީގޮތުން ދުޅަހެޔޮ ޞިއްޙަތަކަށް ވާޞިލުވުމަށް ބޭނުންވާ ޞިއްޙީ ފަރުވާއާއި ޚިދުމަތް، ލިބެންހުރި އެންމެ މަތީ ފެންވަރަކުން ފޯރުކޮށްދިނުމާއެކު، ބަލިވުމުން އެ ބައްޔަކަށް ފަރުވާ ހޯދޭނެ ވަޞީލަތްތައް ލިބުމުގެ ޙައްޤު ކޮންމެ ކުއްޖަކަށްމެ ފޯރުކޮށްދިނުން.
ކުއްޖާގެ ޞިއްޙަތަށް ގެއްލުންލިބިދާނެ ޘަޤާފީ އާދަކާދަތަކާއި ޢަމަލުތަކުން ރައްކާތެރިކަން ކަށަވަރުކޮށްދިނުން.
ދުޅަހެޔޮ ޞިއްޙަތެއްގައި ހެދިބޮޑުވުމަށް ކުއްޖާއަށް ބޭނުންވާ ކާނާއާއި ސާފު ފެން ލިބިދިނުމާއި، އެކަށީގެންވާ ނަރުދަމާ ނިޒާމެއްގެ ޚިދުމަތް ލިބިދިނުމާއި، އެކަށީގެންވާ ފޭރާމާއި ބޯހިޔާވަހިކަން ލިބިދިނުމާއި، ސާފު އަދި ޞިއްޙަތަށް ރަނގަޅު ވެއްޓެއްގައި ހެދިބޮޑުވުމުގެ ޙައްޤު، ކޮންމެ ކުއްޖަކަށްމެ ހޯދައިދިނުން.
ބަލިތަކުން ދުރުވެތިބުމަށް ބޭނުންވާނެ މަޢުލޫމާތާއި، ވަޞީލަތްތަކާއި ޚިދުމަތްތައް ކުއްޖާގެ ޢުމުރާ އެކަށީގެންވާ ގޮތެއްގައި ފޯރުކޮށްދިނުން.
ޞިއްޙަތާ ގުޅިގެން ޤާނޫނުގައި ބަޔާންކުރާ ބައެއް ނުކުތާތައް
- ދުޅަހެޔޮ ޞިއްޙަތެއްގައި ދެމިހުރުމުގެ ޙައްޤު ކޮންމެ ކުއްޖަކަށްމެ ލިބިގެންވާކަން.
- ކުއްޖާއަކީ އަނިޔާ ލިބިފައިވާ ކުއްޖެއްނަމަ، ނުވަތަ ބައްޔެއް ވެފައިވާ ކުއްޖެއްނަމަ، ކޯޓުން ނެރޭ ވަގުތީ އެސެސްމަންޓް އަމުރެއްގައި ޗައިލްޑް އެންޑް ފެމިލީ ޕްރޮޓެކްޝަން ސަރވިސްއިން ނުވަތަ މޯލްޑިވްސް ޕޮލިސް ސަރވިސްއިން ކުއްޖާއަށް ކޮންމެހެން ބޭނުންވާ މެޑިކަލް އެގްޒެމިނޭޝަންތައް ހެއްދުމަށާއި، ޞިއްޙީ ފަރުވާ ދިނުމަށް އަމުރުކުރުމުގެ ބާރު ދެވިދާނެކަން.
- ކުއްޖާއާބެހޭ މައްސަލައެއް ރިޕޯޓްކުރުމުގެ ޒިންމާ އުފުލާ ފަރާތްތަކުގެ ތެރޭގައި އަޅާލުމާއި ރައްކާތެރިކަމަށް ބޭނުންވެފައިވާ ކުއްޖާގެ ޑޮކްޓަރެއް ނުވަތަ އެނޫންވެސް ޞިއްޙީ ޚިދުމަތް ފޯރުކޮށްދޭ ފަރާތެއް ހިމެނޭކަން.
ފުލުހުންގެ ޒިންމާތައް
ކުޑަކުދިންގެ ޙައްޤުތައް ރައްކާތެރިކުރުމުގެ ގޮތުން ކުރެވެން އޮތް އެންމެހާކަންކަން އިސްނަގައިގެން ކުރުން.
މޯލްޑިވްސް ޕޮލިސް ސަރވިސްއަށް ހުށަހެޅޭ މައްސަލައަކާ ގުޅިގެން، ރިޕޯޓުކުރާ ފަރާތުގެ ނަން ނުވަތަ އޭނާއަކީ ކާކުކަން އެނގޭނެ ފަދަ އެނޫންވެސް މަޢުލޫމާތެއް، ނުވަތަ ކުއްޖެއްގެ ކަރާމާތަށް އުނިކަމެއް އަންނާނެފަދަ ގޮތަކަށް އެ ކުދިންގެ މަޢުލޫމާތު ތިންވަނަ ފަރާތަކާ ޙިއްޞާ ނުކުރުން.

ކުޑަކުދިންގެ ޢަދުލުގެ ޤާނޫނުގައިވާ ގޮތުގެމަތިން މެނުވީ އަދި އެންމެ ފަހުގެ ފިޔަވަޅެއްގައި މެނުވީ ކުއްޖަކު ހައްޔަރުކޮށް ނުވަތަ ބަންދު ނުކުރުން.
ފުލުހުންނާ ގުޅިގެން ޤާނޫނުގައި ބަޔާންކުރާ ބައެއް ނުކުތާތައް
- ވަގުތީ އެސެސްމަންޓް އަމުރަކަށް އެދި މޯލްޑިވްސް ޕޮލިސް ސަރވިސްއަށް ކޯޓަށް ހުށަހެޅިދާނެކަން.
- ކޯޓުން ނެރޭ ވަގުތީ އެސެސްމަންޓް އަމުރެއްގައި މޯލްޑިވްސް ޕޮލިސް ސަރވިސްއިން ޤާނޫނުގައި ބަޔާންކުރާ ކަންތައްތަކުގެ ތެރެއިން ކަމެއް ނުވަތަ ކަންތައްތަކެއް ކުރުމަށް އަމުރުކުރުމުގެ ބާރު ދެވިދާނެކަން.
- ވަކި ކުއްޖަކާ ގުޅޭގޮތުން ނެރެފައިވާ ވަގުތީ އެސެސްމަންޓް އަމުރެއްގެ މުއްދަތު އިތުރުކޮށްދިނުމަށް އެދި މޯލްޑިވްސް ޕޮލިސް ސަރވިސްއަށް ކޯޓުގައި އެދެވިދާނެކަން.
- ކުޑަކުދިންގެ ޙައްޤުތައް ރައްކާތެރިކުރުމާބެހޭ ކައުންސިލްގައި ފުލުހުންގެ ފަރާތުން ކަނޑައަޅާ ފަރާތެއް ހިމެނޭކަން.
ޗައިލްޑް އެންޑް ފެމިލީ ޕްރޮޓެކްޝަން ސަރވިސްގެ ޒިންމާ
އެހީތެރިކަމަށް ބޭނުންވެފައިވާ ކުޑަކުދިންނަށާއި އެކުދިންގެ ޢާއިލާތަކަށް އެހީތެރިކަމާއި އެއްބާރުލުން ފޯރުކޮށްދިނުން.
އެހީތެރިކަން ބޭނުންވެފައިވާ ކުޑަކުދިންގެ މަޞްލަޙަތު ޙިމާޔަތްކޮށް، ކުރިއެރުވުން.
ކުޑަކުދިންގެ ޙައްޤުތަކާ ގުޅޭގޮތުން ހުށަހެޅޭ މައްސަލަތައް ބަލައި، ކަމާބެހޭ އިދާރާތަކުގެ އެހީތެރިކަމާއި އެއްބާރުލުމާއެކު، އެ މައްސަލަތަކަށް ޙައްލު ހޯދައިދިނުން.
ކުޑަކުދިންނަށް އަޅާލުމާއި އެހީތެރިކަން ފޯރުކޮށްދިނުމަށްޓަކައި ފެމިލީ ކޮންފަރެންސިންގ، ކައުންސެލިންގ، ސަޕޯޓް ސަރވިސްގެ ޚިދުމަތްތައް، ޤާނޫނީ އެހީތެރިކަމާއި އަދި ރީހެބިލިޓޭޝަން ޚިދުމަތްތައް ދެވޭނެ އިންތިޒާމު ހަމަޖެއްސުން.
މަސްތުވާތަކެތީގެ ޝިކާރައަކަށްވެފައިވާ ކުދިންނަށް ފަރުވާ ދިނުމާގުޅޭ ކަންކަން، ނޭޝަނަލް ޑްރަގް އޭޖެންސީއާ ގުޅިގެން ވިލަރެސްކުރުން.
ދައުލަތުގެ ބެލުމުގެ ދަށަށް ގެނެވޭ ކުޑަކުދިންނާ ގުޅޭގޮތުން މިނިސްޓަރު ކުރަންޖެހޭ ކަމަށް ޤާނޫނުގައި ބަޔާންކޮށްފައިވާ ކަންކަން ޢަމަލީގޮތުން ކުރުން.
ދައުލަތުގެ ބެލުމުގެ ދަށަށް ގެނެވޭ ކުދިން ފޮސްޓަރ ކުރުމާގުޅޭ އެންމެހައި ކަންކަން ކުރުން.
ދައުލަތުގެ ބެލުމުގެ ދަށަށް ގެނެވޭ ކުދިންނާއި ފޮސްޓަރކުރެވޭ ކުދިންނާ ގުޅޭގޮތުން އެކި ދާއިރާތަކުގެ މެދުގައި އެއްބާރުލުން ޤާއިމުކޮށް މަސައްކަތްތައް ވިލަރެސްކުރުން.
ކުޑަކުދިންގެ ތެރެއިން އެހީތެރިކަން ބޭނުންވެފައިވާ ކުދިންގެ ބޭނުންތަކަށް އަމާޒުކޮށްގެން އެކުދިންނަށް ބޭނުންވާ އެހީ ނުވަތަ ޚިދުމަތްތައް ފޯރުކޮށްދިނުން.
ޤާނޫނުގައި ބަޔާންކޮށްފައިވާ ކަންކަމާގުޅޭ މަޢުލޫމާތު ދަފްތަރުކޮށް ބެލެހެއްޓުން.
ކުޑަކުދިންގެ ޙައްޤުތަކާ ގުޅޭގޮތުން ދިރާސާތައް ކުރުން.
ކުޑަކުދިންގެ ޙައްޤުތައް ރައްކާތެރިކުރުމަށްޓަކައި ކުރެވޭ މަސައްކަތްތައް ރާވައި، ހިންގުމަށާއި، މޮނިޓަރކޮށް އިވެލުއޭޓްކުރުމަށްޓަކައި ބޭނުންވާ ތަފާސް ހިސާބުތައް އެއްކުރުމާއި އާންމުކުރުން.

- ކުޑަކުދިންގެ ޙައްޤުތައް ރައްކާތެރިކުރުމާބެހޭ ކައުންސިލްގައި ޗައިލްޑް އެންޑް ފެމިލީ ޕްރޮޓެކްޝަން ސަރވިސްގެ ފަރާތެއް ހިމެނޭކަން.
ތަޢުލީމީ ދާއިރާގެ ޒިންމާ
ދިވެހިރާއްޖޭގައި ދިރިއުޅޭ ކޮންމެ ކުއްޖަކަށްވެސް އެއްވެސް ތަފާތުކުރުމެއް ނެތި އުނގެނުމުގެ ޙައްޤު ކަށަވަރުކޮށްދިނުން.
ދިވެހިރާއްޖޭގައި ދިރިއުޅޭ ކުޑަކުދިންގެ ފަށާ ތަޢުލީމާއި މެދުމަދުރަސީ ތަޢުލީމާއި ތަރުބިއްޔަތާބެހޭ ކަންކަން އުނގަންނައިދިނުން.
އިސްލާމީ ޢަޤީދާއާއި، އުސޫލުތަކާއި އިސްލާމީ ތަރުބިއްޔަތާއި، އިންސާނީ ޙައްޤުތަކަށް އިޙްތިރާމްކުރުމާއި، އެންމެންގެ މެދުގައި ސުލްހަމަސަލަސްކަމާއި ރަޙްމަތްތެރިކަން އޮތުމުގެ މުހިންމުކަމާއި، ދިމިޤްރާތީ ހަމަތަކަށް ބާރުއަޅައި އުނގަންނައިދޭ ތަޢުލީމީ ނިޒާމެއް މެދުވެރިކޮށް ކޮންމެ ކުއްޖަކަށްވެސް އުނގެނުމުގެ ފުރުޞަތު ހަމަޖައްސައިދިނުން.
ކުއްޖާއަށް ތަޢުލީމު އުނގެނުމަށް ހުރަސްއެޅޭ ފަދަ ނުވަތަ ކުއްޖާގެ ޞިއްޙަތަށް ނުވަތަ ކުއްޖާގެ ޖިސްމާނީ ނުވަތަ ނަފްސާނީ ނުވަތަ ރޫޙާނީ ނުވަތަ އިޖްތިމާޢީ ތަރައްޤީއަށް ނޭދެވޭ އަސަރެއް ނުވަތަ ގެއްލުމެއް ކުރިމަތިކުރުވަފާނެ ފަދަ މަސައްކަތްތަކުން ކޮންމެ ކުއްޖަކަށްމެ ރައްކާތެރިކަން ކަށަވަރުކޮށްދިނުން.
އެއްވެސް ކުއްޖަކަށް، އެކުއްޖާ ދިރިއުޅެމުންގެންދާ ގޭތެރޭގައިވެސް ނުވަތަ ތަޢުލީމްދޭ މަރުކަޒެއްގައިވެސް ނުވަތަ ކުއްޖާ ބަލަހައްޓާ މަރުކަޒެއްގައިވެސް ނުވަތަ އެކުއްޖާ ދިރިއުޅޭ އެނޫންވެސް މާޙައުލެއްގައި، ރަޙުމްކުޑަ، ލާއިންސާނީ، ނުވަތަ ކުއްޖާ ލަދުގަންނާނެ ފަދަ އަދަބެއް ނުދިނުން، އަދި އެއްވެސް ބާވަތެއްގެ އަނިޔާއެއް ނުކުރުން.
ކުޑަކުދިން ކުޅިވަރުކުޅެ މުނިފޫހިފިލުވުމަށް ނުކުމެ އުޅެވޭނެ ތަންތަން، ދައުލަތުގެ ތަނަވަސްކަމާއި ކުޅަދާނަކަންހުރި މިންވަރަކުން އެކަށީގެންވާ ރައްކާތެރި އަދި ރަނގަޅު ފެންވަރެއްގައި ޤާއިމުކޮށްދޭންވާނެކަން.
ޤާނޫނާ އެއްގޮތަށް ތަޢުލީމީ ނިޒާމެއް ޤާއިމުކޮށް، އެކަންކަމަށް ވާޞިލުވެވޭނެ މަގުފަހިކޮށްދިނުމާއި، ފަށާ ތަޢުލީމާއި، މެދުމަދަރުސީ ތަޢުލީމު ޙާޞިލުކުރުމުން މަޙްރޫމުވެފައިވާ ކުއްޖަކު ނެތްކަން ކަށަވަރުކުރުން.
ސްކޫލަށް ނުދާ އަދި ނުފޮނުވާ ކުދިން ދެނެގަނެ، އެ ކުދިން ސްކޫލަށް ގެންދާނެ ނިޒާމެއް އެކުލަވާލުން.
ތަޢުލީމީ ދާއިރާއާ ގުޅިގެން ޤާނޫނުގައި ބަޔާންކުރާ ބައެއް ނުކުތާތައް
- އުމުރުން 16 (ސޯޅަ) އަހަރު ނުފުރޭ ކުއްޖަކު، އެކުއްޖެއްގެ ތަޢުލީމާއި ތަރުބިއްޔަތާ ގުޅޭގޮތުން ތަމްރީން ދިނުމަށް މެނުވީ، ވަޒީފާއެއްގައި ނުވަތަ މަސައްކަތެއް ކުރުމަށް ގެންގުޅުމަކީ މަނާކަމެއްކަން.
- ޤާނޫނު ހުއްދަކުރާ ޙާލަތުގައި، ޢުމުރުން 16 (ސޯޅަ) އަހަރު ނުފުރޭ ކުއްޖަކު އެކުއްޖެއްގެ ރުހުމާއެކު ޢާއިލާގެ ފަރާތުން ކުރާ މަސައްކަތެއްގައި ބައިވެރިވެވިދާނެއެވެ. އެހެންނަމަވެސް، ޢާއިލާގެ ފަރާތުން ކުރާ މަސައްކަތެއްގައި ކުއްޖާ ބައިވެރިކުރުމަށް ހުއްދަވާނީ، އެ މަސައްކަތަކީ، ކުއްޖާއަށް ތަޢުލީމު އުނގެނުމަށް ހުރަސްއެޅޭ ފަދަ ނުވަތަ ޞިއްޙަތަށް ނުވަތަ ކުއްޖާގެ ޖިސްމާނީ ނުވަތަ ނަފްސާނީ ނުވަތަ ރޫޙާނީ ނުވަތަ އިޖްތިމާޢީ ތަރައްޤީއަށް ނޭދެވޭ އަސަރެއް ނުވަތަ ގެއްލުމެއް ކުރިމަތިކުރުވަފާނެ ފަދަ މަސައްކަތެއް ކަމުގައިނުވާނަމަކަން.
- ތަމްރީން ދިނުމަށާއި ޢާއިލާއިން ކުރާ މަސައްކަތްތަކުގައި ކުދިން ބައިވެރިކުރުމާބެހޭ އުސޫލުތަކާއި، ކުޑަކުދިން ބައިވެރިކުރުން މަނާ މަސައްކަތްތަކުގެ ތަފްޞީލު ލިސްޓަކާއި، ތަމްރީން ދިނުމަށާއި ޢާއިލާއިން ކުރާ މަސައްކަތްތަކުގައި ބައިވެރިކުރުވާ ކުޑަކުދިންގެ ޙައްޤުތައް ޙިމާޔަތްކުރުމުގެ ގޮތުން ހިފަހައްޓަންޖެހޭ މިންގަނޑުތަކާބެހޭ ގަވާއިދުތައް މި ޤާނޫނަށް ޢަމަލުކުރަން ފަށާތާ 6 (ހައެއް) މަސްދުވަހުގެ ތެރޭގައި އެކުލަވާލައި، އެ ކަންކަން ހިނގާގޮތް، ޤާނޫނު ނަންބަރު (2008/2) ވަޒީފާއާބެހޭ ޤާނޫނުގެ ދަށުން އެކުލަވާލާފައިވާ ލޭބަރ ރިލޭޝަންސް އޮތޯރިޓީން މޮނިޓަރކުރަމުން ގެންދަންވާނެކަން.
އާންމު މުޙިއްމު ބައެއް ނުކުތާތައް
- ވަކި ކުއްޖަކީ، އަޅާލުމާއި ރައްކާތެރިކަން ބޭނުންވާ ކުއްޖެއްކަމަށް ޤަބޫލުކުރެވޭ ކޮންމެ ފަރާތަކުން، މޯލްޑިވްސް ޕޮލިސް ސަރވިސްއަށް ރިޕޯޓުކުރަންވާނެކަން.
- ކުށުގެ ތުހުމަތުގައިވާ ކުދިންނާއި، ކުށުގެ ޝިކާރައަކަށް ވެފައިވާ ކުދިންނާއި، އެނޫންވެސް ސަބަބަކަށްޓަކައި އަޅާލުމާއި ރައްކާތެރިކަން ބޭނުންވާ ކުދިންގެ ނަމާއި، އެޑްރެހާއި، ތަޢުލީމު ޙާޞިލުކުރާ ތަނުގެ މަޢުލޫމާތު ފަދަ ޒާތީ މަޢުލޫމާތެއް ނުވަތަ ސީދާގޮތުން ނުވަތަ ނުސީދާގޮތުން ނަމަވެސް ކުއްޖާއަކީ ކާކުކަން ދެނެގަނެވޭނެ ފަދަ އެއްވެސް މަޢުލޫމާތެއް ނުވަތަ އެކުދިންގެ ތަސްވީރެއް، އެއްވެސް މީޑިއާގެ ނުވަތަ އެނޫންވެސް ވަސީލަތެއްގައި ޝާއިޢުކޮށްގެން ނުވާނެއެވެ.
