Institutions to be audited to see if children's rights are protected
An audit will be launched next month to assess the effectiveness of institutions tasked with protecting and ensuring children's rights within the state system.
Cases of child sexual abuse and neglect have also not been dealt with at the right pace, taking a long time, which results in a loss of faith in state institutions. To rectify the fact that the justice delivery system has failed from a very early stage, the present government has started drafting and implementing a child welfare law.
One of the responsibilities assigned to establish the Children's Ombudsperson's office as an independent body under the Act is to ensure that the state agencies implement the provisions raised under the Child Rights Protection Act. The Office of the Children's Ombudsperson is all set to conduct such an audit for the first time in the country.
Children’s ombudsperson, Niumaath Shafeeq, told "Adadhu" that while the auditing will be carried out in the state institutions, they would look into whether they were proceeding according to the Child Rights Protection Act and what was neglected by the institutions.
"Once we start this audit, the problems will come to the fore," Niumaath said.
She said 20 cases have been registered and investigations are underway since the office was set up. Six of these cases were based on the perception that the office needed to be addressed immediately to take the necessary actions, she said. The office looks into cases that have come to light since 2019. "But if an old case is repeated, we will look into it," Niumaath said.
Niumaath stated that she feels that one of the priorities should be to start following the law and making SOPs. "This is because if rules are not framed, it will open up the possibility of them acting the way they want to," she said. "Once the law comes into force, there is a need to change the earlier rules," she said.
Niumaath doesn't approve of some institutions giving excuses that there is a delay in the formation of rules due to COVID-19. The delay in what needs to be done to prevent child abuse is, she believes, an act of negligence. She said that once the audit reveals the extent of implementation within the legal system, it will consult with the institutions and give time to the issues that need to be improved. "During that period, if it is not implemented, necessary action will be taken," she said.

ކުޑަކުދިންނަށް ޖިންސީގޯނާކުރުމާއި އަނިޔާ އާއި އިހުމާލުގެ މައްސަލަތައް ވެސް މައްސަލަތައް އެންމެ އެކަށީގެންވާ ބާރުމިނުގައި ނުބެލި, ދިގު މުއްދަތެއް ހޭދަވެ މުއައްސަސާތަކަށް އިތުބާރު ވަނީ ކުޑަވެފަ އެވެ. އިންސާފު ހޯދައިދިނުމުގެ ނިޒާމް ވަރަށް ކުރީއްސުރެން ފެށިގެން ފޭލްވެފައި އޮތް ކަން ގަބޫލުކޮށް އެކަން ރަނގަޅުކުރަން މި ސަރުކާރުން ވަނީ ކުޑަކުދިންގެ ހައްގުތައް ރައްކާތެރިކޮށްދިނުމުގެ ގާނޫނެއް އެކުލަވާލައި ތަންފީޒުކުރަން ފަށައިފަ އެވެ.
އެ ގާނޫނުގެ ދަށުން މިނިވަން އިދާރާއެއްގެ ގޮތުގައި ޗިލްޑްރަންސް އޮމްބަޑްސްޕާސަންގެ އޮފީސް އުފައްދައި ހަވާލުކޮށްފައިވާ އެއް ޒިންމާއަކީ ކުޑަކުދިންގެ ހައްގުތައް ރައްކާތެރިކުރުމުގެ ގާނޫނުގެ ދަށުން މަތިކޮށްފައިވާ ކަންކަން ދައުލަތުގެ އިދާރާތަކުން ތަންފީޒުކުރޭތޯ ބެލުމެވެ.
ރާއްޖޭގައި ފުރަތަމަ ފަހަރަށް މިފަދަ އޮޑިޓެއް ކުރިއަށް ގެންދަން ޗިލްޑްރަންސް އޮމްބަޑްސްޕާސަންގެ އޮފީހުން މިހާރު ވަނީ ތައްޔާރުވެފަ އެވެ.
އެ އިދާރާ ހިންގެވުމާ ހަވާލުވެ ހުންނެވި ނިއުމާތު ޝަފީގު "އަދަދު" އަށް ވިދާޅުވީ ޗައިލްޑް ރައިޓްސް އޮޑިޓިންގައި މުއައްސަސާތަކުގެ ކަންކަން ރާވާފައި ހުރިއިރު ކުޑަކުދިންގެ ހައްގުތައް ރައްކާތެރިކުރުމުގެ ގާނޫނުގައި ކަނޑައަޅާފައިވާ ގޮތަށް ކުރިއަށް ގެންދޭތޯ އާއި ނުބެލި އިހުމާލުވެވެނީ ކޮން ކަންތައްތަކަކަށްތޯ ބަލާނެ ކަމަށެވެ.
"މި އޮޑިޓް ކުރަން ފެށީމާ ހުރި މައްސަލަތައް ވަރަށް ބޮޑަށް ފެންމަތިވެގެންދާނެ," ނިއުމާތު ވިދާޅުވި އެވެ.
އޭނާ ވިދާޅުވި ގޮތުގައި އެ އިދާރާ އުފެއްދި ފަހުން މިހާތަނަށް 20 މައްސަލައެއް ހުށަހަޅައި ތަހުގީގު އެބަދެ އެވެ. އޭގެ ތެރެއިން ހަ މައްސަލައަކީ އެ އޮފީހުގެ އިސް ނެގުމަށް ވަގުތުން ހައްލު ހޯދަން ޖެހޭ ކަމަށް ދެކިގެން ބަލާ މައްސަލަތަކެއް ކަން ފާހަގަކުރެއްވި އެވެ.
އޮމްބަޑްސްޕާސަންގެ އޮފީހަށް ބެލެނީ 2019 އިން ފެށިގެން ފެންމަތިވެފައިވާ މައްސަލަތަކެވެ. އެކަމަކު ކުރީގެ މައްސަލައެއް ތަކުރާރުވަމުންދާ ނަމަ އެކަމެއް ބަލާނެ ކަމަށް ނިއުމާތު ވިދާޅުވި އެވެ.
އޭނާ ދެކެވަޑައިގަންނަވާ ގޮތުގައި އެންމެ އިސްކަންދީގެން ކުރަން ޖެހޭ އެއް ކަމަކީ ގާނޫނާ އެއްގޮތަށް މަސައްކަތް ކުރަން ފަށައި އެސްއޯޕީތައް ހެދުމެވެ. އެއީ އުސޫލްތަކެއް ނުހަދައި އޮތް ނަމަ އެ ބަޔަކު ބޭނުންވާ ގޮތަކަށް އަމަލުކުރުމުގެ ފުރުސަތު ހުޅުވިގެންދާނެތީ ކަމަށް ވިދާޅުވި އެވެ. ގާނޫނު ވުޖޫދަށް އައުމާ އެކު ކުރީގައި ހުރި އުސޫލްތައް ބަދަލުކުރަން ޖެހޭ ކަމަށް ވެސް ވިދާޅުވި އެވެ.
ކޮވިޑާ ހެދި އުސޫލްތައް ނުހެދި ލަސްވާ ކަމަށް ބައެއް މުއައްސަސާތަކުން ބަހަނާ ދެއްކުން ނިއުމަތު ގަބޫލެއް ނުކުރައްވަ އެވެ.
"ކޮވިޑުގެ ހާލަތާ އެކު ކުދިންނަށް އަނިޔާ ލިބުން ނުހުއްޓޭ," ނިއުމަތު ވިދާޅުވި އެވެ.
ކުދިންނަށް އަނިޔާ ހުއްޓުވަން ކުރަން ހުރި ކަންކަން ލަސްވުމަކީ އޭނާ ދެކެވަޑައިގަންނަވާ ގޮތުގައި އިހުމާލެކެވެ.
އޭނާ ވިދާޅުވި ގޮތުގައި ގާނޫނީ ނިޒާމުގެ ތެރޭގައި ކަންކަން ތަންފީޒުވަމުންދާ މިންވަރު އެ އޮޑިޓުން ހާމަވުމުން, ރަނގަޅުކުރަން ޖެހޭ ކަންކަމަށް މުއައްސަސާތަކާ އެކު މަޝްވަރާކޮށް މުއްދަތެއް ދޭނެ އެވެ. އެ މުއްދަތުގައި, އެކަން ތަންފީޒު ނުވެއްޖެ ނަމަ އަޅަން ޖެހޭ ފިޔަވަޅުތައް އަޅާނެ ކަމަށް ވެސް ވިދާޅުވި އެވެ.
